Liberty and Law examines a previously underappreciated theme in legal history―the idea of permissive natural law. The idea is mentioned only peripherally, if at all, in modern histories of natural law. Yet it engaged the attention of jurists, philosophers, and theologians over a long period and formed an integral part of their teachings. This ensured that natural law was not conceived of as merely a set of commands and prohibitions that restricted human conduct, but also as affirming a realm of (...) human freedom, understood as both freedom from subjection and freedom of choice. Freedom can be used in many ways, and throughout the whole period from 1100 to 1800 the idea of permissive natural law was deployed for various purposes in response to different problems that arose. It was frequently invoked to explain the origin of private property and the beginnings of civil government. Several kinds of permissive natural law were identified. Permission could be positive or negative, depending on whether it was specifically conceded by a legislator or only tacitly allowed. It could free from sin or merely remit some temporal punishment that was due. It could commend some conduct without commanding it or permit some evil without condoning it. Medieval canonists used the concept of permissive natural law to harmonize the discordant texts that they found in their sources; William of Ockham found it a powerful tool in his defense of Franciscan poverty against papal criticisms; for Richard Hooker it justified both the constitutional structure and the ritual practices of the Anglican church; John Selden used it to uphold the inviolability of contracts, most importantly the contract of government; Hugo Grotius made it a central theme in his treatment of the conduct permissible in waging war; in the eighteenth century Jean Barbeyrac and Jean-Jacques Burlamaqui associated the idea with the emerging doctrine of natural rights. In Liberty and Law, Tierney has presented us with a magisterial and provocative way of interpreting legal history. (shrink)

Used in China as a book of divination and source of wisdom for more than three thousand years, the _I Ching_ has been taken up by millions of English-language speakers in the nineteenth century. The first translation ever to appear in English that includes one of the major Chinese philosophical commentaries, the Columbia _I Ching_ presents the classic book of changes for the world today. Richard Lynn's introduction to this new translation explains the organization of _The Classic of Changes_ (...) through the history of its various parts, and describes how the text was and still is used as a manual of divination with both the stalk and coin methods. For the fortune-telling novice, he provides a chart of trigrams and hexagrams; an index of terms, names, and concepts; and a glossary and bibliography. Lynn presents for the first time in English the fascinating commentary on the _I Ching_ written by Wang Bi, who was the main interpreter of the work for some seven hundred years. Wang Bi interpreted the _I Ching_ as a book of moral and political wisdom, arguing that the text should not be read literally, but rather as an expression of abstract ideas. Lynn places Wang Bi's commentary in historical context. For beginners and devotees alike, Columbia's _I Ching_ is the clearest and most authoritative translation of this ancient classic. (shrink)

Logical psychologism is the position that logic is a special branch of psychology, that logical laws are descriptíons of experience to be arrived at through observation, and are a posteriori.The accepted arguments against logical psychologism are effective only when directed against this extreme version. However, the clauses in the above characterization are independent and ambiguous, and may be considered separately. This separation permits a reconsideration of less extreme attempts to tie logic to psychology, such as those defended by Mill and (...) Boole. It also provides the basis for a reexamination of the relationship between logic and psychology, and raises the possibility of a deeper investigation into the nature of logic itself. (shrink)

What motivates manufacturing companies to make costly investments in producing in an environmentally clean manner? The traditional argument is that such behaviour is value reducing, and that therefore, firms must be forced by regulation to invest in "green" production processes. A counter-argument is that firms have an incentive to make environmental investments in an attempt to attract "green" consumers and investors, hence gaining competitive advantage over their rivals. In this paper, we employ a game-theoretic approach that demonstrates that competing firms' (...) incentives to make voluntary investments in environmental "clean-up" are affected by the size of the investment costs and the extent of consumer and investor "green" awareness. We argue that an increase in green behaviour can be induced by a combination of governmental subsidies for firms that invest in environmentally clean production processes, together with an education program that promotes "green" awareness amongst consumers, investors and the managers themselves. Bioethicists commenting on conscientious objection and abortion should consider the empirical data on abortion providers. Abortion providers do not fall neatly into groups of providers and objectors, and ambivalence is a key theme in their experience. Practical details of abortion services further upset the dichotomy. These empirical facts are important because they demonstrate that the way the issue is described in analytical bioethics does not reflect reality. Addressing conscientious objection as a barrier to patient access requires engaging with those who (...) provide the service and those who are able to but do not. The experiences of doctors facing these decisions potentially challenge and expand our understanding of the issue as an ethical concern. (shrink)

The use of lateralised cues by predators and fellows may not strongly affect lateralisation. Conservatism of development is a possible source of consistency across vertebrates. Individuals with partial reversal, affecting only one ability, or with varying degree of control of response by one hemisphere do exist. Their incidence may depend on varying selection of behavioural phenotypes such as risk taking.

The landscape of the Sundarbans today is a product of two countervailing forces: conversion of wetland forests to cropland vs. sequestration of the forests in reserves to be managed for long-term sustained yield of wood products. For two centures, land-hungry peasants strove to transform the native tidal forest vegetation into an agroecosystem dominated by paddy rice and fish culture. During the colonial period, their reclamation efforts were encouraged by landlords and speculators, who were themselves encouraged by increasingly favorable state policies (...) (land grants, tax incentives, cadastral surveys, and eventually colonization projects and subsidized irrigation) designed by revenue officials to maximize the rate of transformation of wetland forest to taxable agricultural land.In the late nineteenth century, as the rate of agricultural conversion increased, the colonial Forest Department succcessfully sought to preserve large areas of the remaining Sundarbans tidal forest by giving them legal status as Reserved or Protected Forests. These forests were intensively managed to provide a sustainable supply of timber and firewood for the increasing population of southern Bengal. Institutionalization of conflicting policies by the Revenue and Forest Departments reflected the escalating needs for both food and forest products as the colony grew. Today, supplies of some economically valuable trees have been depleted, and some mammals are locally extinct (although the Bengal tiger remains), but government policy in both Bangladesh and India now favors use of the Sundarbans as forest rather than its transformation to agricultural land. Further expansion of cropland to meet the grain demands of the burgeoning Bengali population in both nations has largely taken place outside the boundaries of the Sundarbans. Overexploitation of these forests for wood products remains a possibility, but large-scale clearing for rice paddies is unlikely under present policies. (shrink)

It touches on the fate of Christianity but mainly covers Buddhism, Shinto, and Neo-Confucianism, particularly the latter. Of central concern is the constant debate over how society should be organized and how the individual can achieve self-fulfilment as just one element of a larger whole. It touches on such matters as ritual, pilgrimage, and religion in practice, but the emphasis is on ideological debate, disagreement, and consensus.

In this paper, we argue that the exclusive disjunction – appropriation or appreciation – rests on a false distinction between the two. We also show that this distinction presupposes a false normative principle that to the extent that x is appreciation rather than appropriation, then x is not – relevant to this issue – a wrong. Against these presuppositions, we defend the view that appropriation is already built into appreciation. This does not mean that we cannot ask questions of appreciation, but that questions of appreciation do not preclude the problematics of appropriation. (shrink)

Background: Editorial peer review is universally used but little studied. We examined the relationship between external reviewers' recommendations and the editorial outcome of manuscripts undergoing external peer-review at the Journal of General Internal Medicine. Methodology/Principal Findings: We examined reviewer recommendations and editors' decisions at JGIM between 2004 and 2008. For manuscripts undergoing peer review, we calculated chance-corrected agreement among reviewers on recommendations to reject versus accept or revise. Using mixed effects logistic regression models, we estimated intra-class correlation coefficients at the (...) reviewer and manuscript level. Finally, we examined the probability of rejection in relation to reviewer agreement and disagreement. The 2264 manuscripts sent for external review during the study period received 5881 reviews provided by 2916 reviewers; 28% of reviews recommended rejection. Chance corrected agreement on rejection among reviewers was 0.11. In mixed effects models adjusting for study year and manuscript type, the reviewer-level ICC was 0.23 and the manuscript-level ICC was 0.17. The editors' overall rejection rate was 48%: 88% when all reviewers for a manuscript agreed on rejection and 20% when all reviewers agreed that the manuscript should not be rejected. Conclusions/Significance: Reviewers at JGIM agreed on recommendations to reject vs. accept/revise at levels barely beyond chance, yet editors placed considerable weight on reviewers' recommendations. Efforts are needed to improve the reliability of the peer-review process while helping editors understand the limitations of reviewers' recommendations. © 2010 Kravitz et al. (shrink)

Conceived in Liberty is a cultural, sociological and geopolitical review of the uniquely American notion that the country and its people are "exceptional." While all nations have their own patriotic commitments, no other people have outwardly declared their power as vigorously as have Americans, especially since World War II. John J. Tierney, Jr. advances the idea that liberty is the singular source of the power of the American worldview and all other elements of this society--equality, patience, charity, justice, (...) etc.--are derived from liberty. He argues that this worldview comes from this one source and is responsible for the many movements that may engage the public's interest, such as women's rights, civil rights, and voting rights. Such movements are all positive, but they could not exist in a society devoid of liberty. Conceived in Liberty also traces other main components of the American worldview: geographic expanse, immigration, energy of the populace, diversity, public policies, and the elements that contribute to exceptionalism. Tierney is not blind to some of the deficiencies of the United States, but he posits that the liberty it manifests is truly the political globe's last, best hope. (shrink)

Aristotle's essentialism is generally recognized as involving a distinction between what belongs to something _in itself (kath' hauto) and what belongs to it _accidentally (kata sumbebekos). But he distinguishes two relevant senses of "_in itself"; the first referring to what belongs to something in _what it is, the second referring to such attributes as: odd to number, male to animal, curved to line, and white to surface. I set out these distinctions, and argue that Aristotle counts the second class of (...) _in itself attributes as being just as essential to the individual substances to which they belong as the first. In her recent, provocative essay “What Is the Point of Equality?”, Elizabeth Anderson argues against a common ideal of egalitarian justice that she calls “ luck egalitarianism” and in favor of an approach she calls “democratic equality.”1 According to the luck egalitarian, the aim of justice as equality is to eliminate so far as is possible the impact on people’s lives of bad luck that falls on them through no fault or choice of their own. In the ideal luck egalitarian (...) society, there are no inequalities in people’s life prospects except those that arise through processes of voluntary choice or faulty conduct, for which the agents involved can reasonably be held responsible. Anderson asserts that the adherents of luck egalitarianism, which can be elaborated in many different ways, include John Roemer, Erik Rakowski, Thomas Nagel, Ronald Dworkin, Gerald Cohen, Richard Arneson, and Philippe Van Parijs.2 In contrast, according to the democratic equality conception, justice as equality requires an end to oppressive social relationships. In the ideal society of democratic equality, the social conditions of everyone’s freedom are secured, each stands to every other in a relationship of fundamental equality, including equal respect, and all have real freedom to participate in democratic self-government. In his Inductive Inference and Its Natural Ground: An Essay in Naturalistic Epistemology, Hilary Kornblith presents an argument for the justification of induction that is bold, brilliant, and plausible, but radically incomplete. In the development of this position, Kornblith relies heavily on the philosophical work of Richard Boyd as well as on some empirical psychological studies. As Kornblith sees it, the philosophical position entailed by his proposed solution to the problem is a thoroughgoing, realistic, scientific materialism. I will argue (...) that the brand of realism that Kornblith’s solution to the problem of induction presupposes is inexplicable within the context of the non-reductive materialism that he espouses. Although Kornblith provides us with valuable elements for a solution to the problem of induction, it needs to be supplemented with something like a renovated Aristotelian notion of form in order for the solution to be plausible.
